AACE Claims & Dispute Resolutions Subcommittee Gains the Expertise of Mark F. Nagata

Please congratulate Mark F. Nagata, PSP, as the 2022-2023 Chair of the Claims & Dispute Resolutions Subcommittee. Mark’s expertise lies in the areas of construction claims preparation and evaluation, development, and review of critical path method (CPM) schedules, schedule delay analysis, construction claim preparation and evaluation training, dispute resolution, and specification writing.

Mark directs and performs all types of analyses from schedule delay analyses to inefficiency analyses and the calculation of damages. Mark has been qualified as an expert witness and has testified on the issues of delay, cost and damages, and wrongful termination. Mark has also presented at mediation and has extensive experience authoring expert reports, written testimony, interrogatories, discovery requests, questions for deposition and cross-examination; and developing demonstrative trial exhibits.

Mark was a contributing author, and continues to provide additional revisions, to the AACE International Recommended Practice No. 29R-03, Forensic Schedule Analysis, which is the first publication in the industry that comprehensively classifies schedule analysis techniques. Mark’s contribution included describing and defining MIPs 3.3, 3.4, and 3.5, which are known as the Contemporaneous Period Analysis and the Contemporaneous Schedule Analysis. He also authors technical papers and articles for industry publication, and speaks nationally on scheduling and claims analysis topics, such as schedule delay analysis methods, inefficiency (use of the Measured Mile), and the calculation of construction damages.

In addition to assisting clients in litigation, Mark evaluates project performance, prepares and evaluates change orders, and works with project teams to resolve disagreements and avoid disputes during construction.
